Els propietaris i empreses gestores han iniciat una batalla legal contra la Generalitat, reclamant indemnitzacions milion\u00e0ries per les mesures que afecten aquests allotjaments. Aquest conflicte podria transformar significativament el panorama de lloguer vacacional a Barcelona i del sector immobiliari en general.<\/p>\n<h2>Qu\u00e8 ha passat?<\/h2>\n<p>L&#8217;origen del conflicte est\u00e0 en el decret aprovat per la Generalitat al novembre, que obliga 47 municipis amb alta tensi\u00f3 en el mercat de l&#8217;habitatge a redactar plans urban\u00edstics per regular els apartaments tur\u00edstics. Si aquests plans no s&#8217;aproven abans de 2028, les llic\u00e8ncies dels pisos tur\u00edstics quedaran anul\u00b7lades autom\u00e0ticament.<br \/>\nA Barcelona, l&#8217;alcalde Jaume Collboni ha deixat clar que seguir\u00e0 aquesta estrat\u00e8gia, la qual cosa posa en perill gaireb\u00e9 10.000 apartaments tur\u00edstics amb llic\u00e8ncia a la ciutat. Aquests representen el 40% de l&#8217;oferta d&#8217;allotjament tur\u00edstic a la capital catalana.<\/p>\n<h2>Indemnitzacions milion\u00e0ries<\/h2>\n<p>Fins al moment, uns 1.500 propietaris i 25 empreses gestores han sol\u00b7licitat compensacions, arribant a un total de 1.000 milions d&#8217;euros, segons la patronal Apartur. La mitjana d&#8217;aquestes reclamacions \u00e9s d&#8217;uns 650.000 euros per pis, tot i que s&#8217;estima que l&#8217;impacte total podria arribar als 3.000 milions d&#8217;euros nom\u00e9s a Barcelona. A nivell de Catalunya, les xifres podrien disparar-se fins als 7.000 milions d&#8217;euros.<br \/>\nAquestes indemnitzacions busquen cobrir tant les inversions realitzades en la compra i adequaci\u00f3 de les vivendes com les guanys projectades que ja no podran obtenir-se.<\/p>\n<h2>Impacte en el mercat immobiliari a Barcelona<\/h2>\n<p>La regulaci\u00f3 dels pisos tur\u00edstics genera un debat profund sobre l&#8217;equilibri entre l&#8217;oferta d&#8217;habitatge i el turisme. D&#8217;una banda, aquestes mesures busquen alleujar la pressi\u00f3 sobre els residents, millorant l&#8217;acc\u00e9s a l&#8217;habitatge. D&#8217;altra banda, els propietaris d&#8217;apartaments tur\u00edstics argumenten que la normativa vulnera drets adquirits i desincentiva futures inversions en el mercat immobiliari a Barcelona.<\/p>\n<h2>El futur de lloguer vacacional<\/h2>\n<p>El sector de lloguer vacacional a Barcelona es troba en una encru\u00efxada. Les decisions que es prenguin en els propers anys no nom\u00e9s afectaran els propietaris i gestors d&#8217;apartaments, sin\u00f3 tamb\u00e9 l&#8217;atractiu tur\u00edstic de Barcelona i l&#8217;equilibri entre residents i visitants.<\/p>\n<p>Decret de Pisos Tur\u00edstics a Barcelona: Avan\u00e7os, Reclamacions i Debat Jur\u00eddic<\/p>\n<p>El sector dels pisos tur\u00edstics a Barcelona segueix en el centre d&#8217;una pol\u00e8mica que no cessa. El decret aprovat per la Generalitat no nom\u00e9s ha generat una allau de reclamacions administratives, sin\u00f3 que tamb\u00e9 s&#8217;enfronta a reptes legals i pol\u00edtics que podrien canviar el seu futur.<\/p>\n<h2>Reclamacions patrimonials: una &#8220;expropiaci\u00f3 encoberta&#8221;<\/h2>\n<p>El president d&#8217;Apartur, Enrique Alc\u00e1ntara, ha descrit el decret com una &#8220;expropiaci\u00f3 encoberta&#8221;, argumentant que retira drets adquirits en anul\u00b7lar llic\u00e8ncies de pisos tur\u00edstics. Alc\u00e1ntara ha animat el sector a mobilitzar-se i presentar reclamacions abans de l&#8217;8 de novembre, data l\u00edmit per aquestes accions. Segons ell, el perjudici econ\u00f2mic per als propietaris \u00e9s evident, ja que les llic\u00e8ncies representen una inversi\u00f3 significativa i una font d&#8217;ingressos leg\u00edtima.<br \/>\nLa directora general d&#8217;Apartur, Marian Muro, ha subratllat que el decret s&#8217;enfronta a m\u00e9s dos fronts legals addicionals: un recurs d&#8217;inconstitucionalitat presentat pel Partit Popular davant el Tribunal Constitucional i una investigaci\u00f3 oberta per la Comissi\u00f3 Europea per presumptes infraccions de normatives europees. Aquest panorama jur\u00eddic reflecteix la complexitat del debat sobre si els registres de vivendes d&#8217;\u00fas tur\u00edstic s\u00f3n llic\u00e8ncies, habilitacions o declaracions responsables. Per Muro, el debat \u00e9s irrellevant: \u201cEs tracta d&#8217;una habilitaci\u00f3 administrativa i, per tant, d&#8217;una llic\u00e8ncia.\u201d<\/p>\n<h2>El paper de Salvador Illa i el futur pol\u00edtic del decret<\/h2>\n<p>En el pla pol\u00edtic, el sector mant\u00e9 esperances que l&#8217;actual president de la Generalitat, Salvador Illa, revisi i flexibilitzi el decret. El text va ser aprovat pel govern anterior d&#8217;ERC com un decret-llei d&#8217;urg\u00e8ncia, per\u00f2 el PSC plantejava tramitar-lo com una llei ordin\u00e0ria per adaptar-lo a les diferents realitats de Catalunya. Alc\u00e1ntara ha sol\u00b7licitat reunir-se amb Illa per abordar possibles modificacions, mentre critica la manca de di\u00e0leg amb l&#8217;alcalde de Barcelona, Jaume Collboni.<br \/>\nD&#8217;altra banda, la consellera de Territori i Habitatge, S\u00edlvia Paneque, ha afirmat que el decret no patir\u00e0 modificacions significatives, excepte ajustos puntuals en alguns municipis. Aquesta posici\u00f3 posa de manifest la tensi\u00f3 entre les demandes locals i la visi\u00f3 global del govern catal\u00e0 sobre la regulaci\u00f3 dels apartaments tur\u00edstics.<\/p>\n<h2>La controv\u00e8rsia amb el sector hoteler<\/h2>\n<p>El president d&#8217;Apartur tamb\u00e9 ha assenyalat una possible negociaci\u00f3 entre el lobby hoteler i l&#8217;alcalde Collboni. Segons Alc\u00e1ntara, mentre els pisos tur\u00edstics s&#8217;enfronten a una regulaci\u00f3 estricta, els hotels han contribuit hist\u00f2ricament a la p\u00e8rdua de s\u00f2l residencial, una cosa que, segons ell, no ha estat objecte d&#8217;una supervisi\u00f3 comparable.
