Despr\u00e9s de mesos de debat i un gir del PSC, el Govern ha arribat a un acord amb ERC, els Comuns i la CUP per incloure els contractes de lloguer de temporada dins del marc de control de preus previst per la Llei d\u2019Habitatge.<\/p>\n<p>Tot i que aquesta mesura no elimina aquest tipus de contractes, representa un primer pas rellevant per limitar-ne els usos abusius, especialment en ciutats com Barcelona, on s\u2019havien convertit en una via habitual per esquivar la regulaci\u00f3. L\u2019objectiu \u00e9s posar ordre en un mercat que fins ara creixia pr\u00e0cticament sense regulaci\u00f3.<\/p>\n<h3>Lloguers de temporada s\u00ed, per\u00f2 amb l\u00edmits<\/h3>\n<p>Els contractes de lloguer de temporada \u2014pensats per a estades curtes, vacances, estudis o feines temporals, amb una durada m\u00e0xima d\u201911 mesos\u2014 no desapareixen. Per\u00f2 a partir d\u2019ara, hauran d\u2019ajustar-se a l\u2019\u00edndex de refer\u00e8ncia de preus marcat per la llei, sempre que l\u2019immoble estigui ubicat en una zona de mercat tensat, com moltes de les \u00e0rees de Barcelona.<\/p>\n<p>Fins ara, aquesta f\u00f3rmula s\u2019utilitzava per evitar el control de preus, permetent lloguers per mesos a preus molt superiors als del mercat, sovint destinats a expatriats o a llogaters amb alt poder adquisitiu. Aquesta situaci\u00f3 deixava molts residents habituals en desavantatge.<\/p>\n<p>Un dels punts clau de la nova normativa \u00e9s que el contracte haur\u00e0 d\u2019especificar clarament si es tracta d\u2019un lloguer habitual o de temporada. A m\u00e9s, la persona llogatera haur\u00e0 d\u2019acreditar que t\u00e9 la seva resid\u00e8ncia habitual en un altre lloc. Aquest pas no elimina del tot les males pr\u00e0ctiques, per\u00f2 introdueix m\u00e9s transpar\u00e8ncia i redueix el marge per a abusos.<\/p>\n<p>Tanmateix, s\u2019obre un nou repte: l\u2019\u00fas massiu dels contractes temporals podria convertir-se en la norma, afectant la estabilitat de molts inquilins que es veuran obligats a encadenar contractes curts.<\/p>\n<p>Tamb\u00e9 es regula el lloguer d\u2019habitacions: la suma total de les rendes de totes les habitacions no podr\u00e0 superar el preu m\u00e0xim legal que tindria el pis si es llogu\u00e9s sencer. Un pas endavant per evitar abusos en els pisos compartits.<\/p>\n<h3>Inspeccions i control: noves eines per evitar abusos<\/h3>\n<p>Una de les novetats m\u00e9s destacades \u00e9s la creaci\u00f3 del cos d\u2019inspectors d\u2019habitatge, que formar\u00e0 part de la futura Llei del Dret a l\u2019Habitatge de Catalunya. Aquest personal podr\u00e0 revisar contractes, detectar cl\u00e0usules abusives i proposar sancions, tant mitjan\u00e7ant revisions documentals com amb visites in situ.<\/p>\n<p>L\u2019objectiu \u00e9s clar: dotar l\u2019administraci\u00f3 de mecanismes reals per controlar el compliment de la normativa, especialment en entorns on han proliferat pr\u00e0ctiques irregulars o fraudulentes.<\/p>\n<p>A m\u00e9s, l\u2019acord refor\u00e7a la protecci\u00f3 dels habitatges de protecci\u00f3 oficial (HPO) en zones de mercat tensat com Barcelona. S\u2019amplien els terminis durant els quals aquests pisos no podran passar al mercat lliure, amb proteccions que s\u2019allargaran entre 10 i 30 anys, segons el tipus d\u2019habitatge i la naturalesa del s\u00f2l.<\/p>\n<p>Nom\u00e9s podran accedir a la compra d\u2019aquests pisos les persones inscrites al registre de sol\u00b7licitants d\u2019habitatge, evitant que acabin en mans especulatives.<\/p>\n<h3>Nou registre de grans tenidors i lluita contra l\u2019especulaci\u00f3<\/h3>\n<p>L\u2019acord tamb\u00e9 preveu la creaci\u00f3 d\u2019un registre de grans tenidors, que fins ara nom\u00e9s inclo\u00efa empreses i fons d\u2019inversi\u00f3. A partir d\u2019ara, s\u2019hi podran incloure tamb\u00e9 persones f\u00edsiques amb m\u00faltiples propietats, la qual cosa facilitar\u00e0 l\u2019aplicaci\u00f3 d\u2019impostos i mesures fiscals per frenar l\u2019especulaci\u00f3.<\/p>\n<p>A m\u00e9s, es prorrogar\u00e0 la protecci\u00f3 dels habitatges de protecci\u00f3 oficial que estaven a punt de perdre aquesta condici\u00f3. Segons dades del Govern, prop de 36.000 habitatges podrien quedar fora del r\u00e8gim de protecci\u00f3 fins al 2030, dels quals 8.000 ja aquest any. Ara, aquests pisos es podran mantenir com a protegits si es troben dins d\u2019una zona de mercat tensat declarada.<\/p>\n<p>Tot plegat arriba despr\u00e9s de fortes mobilitzacions socials i pressions per part de col\u00b7lectius com el Sindicat de Llogateres, que han denunciat durant temps la manca de regulaci\u00f3 i han celebrat aquest pas com un aven\u00e7, encara que arribi tard.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>L\u2019acord entre el Govern, ERC, Comuns i la CUP inclou per primera vegada aquest tipus de contractes dins la normativa d\u2019habitatge Catalunya es prepara per aplicar canvis importants en el mercat del lloguer.
